Terms and Conditions of Sale and Use
GENERAL
These general terms and conditions of sale apply to all orders placed on the website www.atelier-i-mana.com (hereinafter the “Site”), operated by the company Jakosamos, registered under SIRET number 79929663700033, created by El M anami Fortmann, with its registered office at 99 Avenue Achille Peretti, 92200 Neuilly-sur-Seine, France. Contact email: contact.atelier.imana@gmail.com, phone: 0954182629. The Site is hosted by WIX.COM LTD, 5 Yunitsman St, Tel Aviv-Yafo, 6936025, Israel.
The terms applicable to any order are those in effect at the time the order is placed. Any order confirmed by the consumer on the online store www.atelier-i-mana.com implies prior acceptance of these terms and conditions, acknowledgment of having read and understood them, and waiver of any other purchasing conditions. Hereinafter referred to as the “Customer” or “You”.
The company Jakosamos reserves the right to modify these Terms and Conditions at any time.
PRICES
Prices displayed on the Site are in euros and include all applicable taxes (company under VAT exemption regime pursuant to Article 293B of the French General Tax Code).
Shipping costs are not included and are specified during the order process.
Atelier i-mana reserves the right to modify its prices at any time. However, the price displayed on the Site on the day the order is placed shall be the price applicable to the Customer.
DELIVERY
Orders may only be delivered to the countries specified on the Site. Orders cannot be shipped to any other countries.
Delivery times vary depending on product availability.
For items in stock, orders are generally shipped within one (1) week after receipt of the order and payment (see shipping rates and delivery times).
For made-to-order items, delivery times are specified on each product page.
Delivery times provided by Atelier i-mana may vary depending on the destination country.
Delivery times may be extended due to product customization, workshop workload, or health issues affecting the artisan. In such cases, Atelier i-mana undertakes to inform its customers.

Shipping rates:

Metropolitan France
Colissimo shipping is free for orders equal to or over €100.
For orders under €100, Colissimo shipping fees start from €5. -
European Union (excluding France), United Kingdom, Switzerland
Colissimo International shipping costs €15. -
United Kingdom, Colissimo International shipping costs €19.
Shipping is free for orders equal to or over €200. -
Singapore, Taiwan, Canada, Australia, New Zealand
Colissimo International shipping costs €35.
Shipping is free for orders equal to or over €300. -
Japan
Two shipping options are available via La Poste:-
International Tracked Letter: €15, delivery time from approximately 7 days to several weeks after dispatch. Free for orders equal to or over €200.

Colissimo International (signature required): €35, estimated delivery time of approximately one week after dispatch. Free for orders equal to or over €300.
Deliveries to Japan are not guaranteed at all times and are only available during periods when shipping to Japan is open.

For deliveries outside the European Union, customs duties, import taxes, or other fees may apply. These charges are the sole responsibility of the Client, in accordance with the legislation of the destination country.
The Client is responsible for ensuring that the delivery address provided is accurate and complete. Atelier i-mana cannot be held liable for delivery delays due to incorrect addresses, Customer absence, weather conditions, carriers, or customs procedures.
Products are delivered to the address indicated at the time of the order.
PAYMENT
Payment is accepted via secure platforms Stripe and PayPal.
Payment by bank transfer or check(français) is also possible. Orders paid by bank transfer or check are confirmed only upon receipt of payment. Payment details are provided by email.
If payment is not received within seven (7) days, the order will be canceled.
Products remain the property of Atelier i-mana until full payment has been received.
Refunds will be issued using the same payment method used for the original transaction.
ORDERS
For made-to-order items, production times are specified on each product page and are provided as an estimated number of weeks, depending on the number of ongoing orders.
For items in stock, orders are generally shipped within one (1) week after receipt of payment.
If Atelier i-mana determines that standard production times have been exceeded, it may temporarily suspend order acceptance.
Orders are limited to the countries specified on the Site.
The Client may add products to a virtual shopping cart and access the order summary to confirm the products before placing the order by clicking “Order”.
Placing an order requires providing a valid delivery address, shipping method, and payment method and constitutes the formation of a distance sales contract between Atelier i-mana and the Client.
An order confirmation email summarizing the order and delivery details will be sent to the Client.
Atelier i-mana may offer price reductions, discounts, or rebates depending on the number of products ordered or the regularity of orders, according to conditions set by the company.
PRODUCT FEATURES
Each embroidered product from Atelier i-mana is handcrafted. Due to this artisanal process, slight variations in color, size, or materials may occur.
The Customer acknowledges that photographs, descriptions, or illustrations are indicative and non-contractual and cannot engage the Seller’s liability in case of error, omission, or modification.
The Buyer benefits from a 2-year legal conformity guarantee for manufacturing defects existing at the time of purchase.
During this guarantee period, and at our discretion, the product may be repaired depending on the availability of parts, except for stationery products.
The guarantee does not cover damage resulting from misuse, failure to follow care instructions, external modifications, or accidents.
Unless a manufacturing defect is proven, shipping costs remain the responsibility of the Customer.
Outside the guarantee conditions, Atelier i-mana offers a paid repair service for embroidered products, within feasible limits. The repair price is determined based on the condition of the item and is payable prior to repair. Atelier i-mana reserves the right to refuse repairs depending on the item’s condition.
Repair times range from 3 to 6 weeks from receipt of the product at the workshop and may vary depending on activity. This service is non-refundable once the repair is completed.
RIGHT OF WITHDRAWAL
1) General principle
In accordance with applicable law, the Customer has fourteen (14) days to exercise the right of withdrawal without providing a reason or paying penalties, except for shipping costs once the product has left the workshop.
The Customer must notify Atelier i-mana of their decision via the store contact form (“Contact”).
Refunds cover the order value (product and initial shipping). Return shipping costs are not included and remain the responsibility of the Customer.
Products must be returned in their original condition, suitable for resale. Products that are damaged, used, or missing included goodies will not be accepted.
Except for defective items requiring remanufacture, only returns are accepted.
Refunds are processed via the original payment method within fourteen (14) days following notification and receipt of the returned product.
2) Conditions for exercising the right of withdrawal
The right of withdrawal applies only to individuals.
In accordance with Article L.121-20 of the French Consumer Code, it does not apply to goods made to the Customer’s specifications or clearly personalized.
Custom made-to-order personalized products are therefore excluded from the right of withdrawal.
Only standard, non-customized products sold to individuals are eligible.
REGISTRATION
Site registration is open to all individuals or legal entities of legal age with full legal capacity.
Registration is mandatory to use the Site and is free of charge.
Users must complete all required fields and ensure that all information provided is accurate and up to date.
Each user has a unique login and password, which must remain confidential. Atelier i-mana cannot be held responsible for identity theft.
Each user may hold only one account. In case of violation of these Terms (false information, multiple accounts), Atelier i-mana reserves the right to suspend or delete the account.
Account deletion results in loss of all associated benefits, without affecting orders already placed. Re-registration without prior authorization is prohibited.
INTELLECTUAL PROPERTY
Access to www.atelier-i-mana.com grants a private, non-exclusive right of use.
All logos, images, photographs, texts, and other content are the property of Jakosamos or used with authorization and are protected by intellectual property laws. Any reproduction, in whole or in part, without prior written authorization is prohibited.
Users must not publish or transmit any content that could harm privacy, honor, reputation, or brand image, including defamatory, malicious, or threatening content.
The Site structure, software, databases, images, know-how, and all components of www.atelier-i-mana.com are the exclusive property of Atelier i-mana.
Atelier i-mana is a registered trademark. Legal action may be taken in case of infringement.
GOVERNING LAW AND DISPUTES
These Terms are written in French and governed by French law.
In the event of a dispute, French courts shall have exclusive jurisdiction.
PERSONAL DATA
The Site is committed to protecting Customers’ personal data.
All personal data collected via www.atelier-i-mana.com is treated confidentially in accordance with the Site’s privacy policy and is used solely for order processing.
